Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Kresov platform, including the Discord bot, dashboard, APIs, SDKs, mobile applications, marketplace, documentation and any related services (collectively, the "Services").

By inviting, accessing or using any part of the Services, you agree to be bound by these Terms.

If you do not agree with these Terms, you must not use the Services.

1. Definitions

  • "Kresov" refers to the software platform developed and operated by Mynauk Tech.
  • "User" means any individual using the Services.
  • "Server Owner" means the owner of a Discord server using Kresov.
  • "Extension" means any community-created module available through the Kresov Marketplace.
  • "Services" means all applications, APIs, SDKs, bots, dashboards and related software provided by Kresov.

2. Eligibility

You must comply with:

  • Discord's Terms of Service;
  • Discord's Developer Terms (where applicable);
  • all applicable laws and regulations.

You may not use the Services if prohibited by applicable law.

3. Acceptable Use

You agree not to:

  • use the Services for illegal purposes;
  • attempt to exploit security vulnerabilities;
  • interfere with the operation of the Services;
  • abuse rate limits;
  • reverse engineer or attempt to bypass security mechanisms;
  • distribute malware or harmful software through the Services;
  • use the Services to harass, abuse or harm others;
  • use automated systems to excessively interact with the Services.

4. Discord Compliance

Use of Kresov must always comply with Discord's Terms of Service and Community Guidelines.

Violation of Discord's policies may result in suspension or termination of access to Kresov.

5. User Content

Users retain ownership of the content they submit.

By using the Services, you grant Kresov the limited rights necessary to:

  • process commands;
  • store configuration;
  • provide requested functionality;
  • generate logs or backups when requested.

Kresov does not claim ownership of your content.

6. Marketplace

The Marketplace may allow third-party developers to publish Extensions.

Mynauk Tech does not guarantee:

  • quality;
  • security;
  • compatibility;
  • availability;
  • maintenance

of third-party Extensions.

Users install third-party Extensions at their own discretion.

7. Availability

The Services are provided on a best-effort basis.

While reasonable efforts are made to ensure uptime, Kresov does not guarantee uninterrupted availability.

Maintenance, updates or unforeseen incidents may temporarily interrupt the Services.

8. Data

Kresov processes only the data required to provide its Services.

9. Accounts and Authentication

Certain Services require Discord authentication.

Users are responsible for maintaining the security of their Discord account.

Kresov is not responsible for unauthorized access resulting from compromised Discord accounts.

10. API Usage

API access may be subject to:

  • authentication;
  • rate limits;
  • quotas;
  • versioning.

Abuse of the API may result in temporary or permanent access restrictions.

11. Intellectual Property

Unless otherwise stated, all software, branding, documentation and assets are the property of Mynauk Tech.

You may not:

  • redistribute proprietary components;
  • copy substantial portions of the platform;
  • use Kresov trademarks without permission.

12. Open Source Components

Kresov may include or depend upon third-party open-source software.

Such software remains subject to its respective licenses.

13. Suspension and Termination

Kresov reserves the right to suspend or terminate access to the Services if:

  • these Terms are violated;
  • abuse is detected;
  • security is compromised;
  • required by law.

14. Disclaimer

The Services are provided "AS IS" and "AS AVAILABLE".

To the maximum extent permitted by law, Mynauk Tech disclaims all warranties, including but not limited to:

  • merchantability;
  • fitness for a particular purpose;
  • uninterrupted availability;
  • error-free operation.

15. Limitation of Liability

To the maximum extent permitted by law, Mynauk Tech shall not be liable for:

  • indirect damages;
  • loss of profits;
  • data loss;
  • service interruptions;
  • consequential damages.

16. Changes

These Terms may be updated at any time.

Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

17. Governing Law

These Terms shall be governed by the laws applicable in the jurisdiction of Mynauk Tech, without regard to conflict of law provisions.
